Customer Advisory: Upcoming Phase 3 Release of the EU’s ICS2

The European Union (EU) follows a multi-layered, risk-based approach to Customs Security. A measure affecting all modes of transport was the introduction of the Entry Summary Declaration (ENS), which entered into force on 1st January 2011.
Phase three of the EU’s new advanced cargo information system, Import Control System 2 (ICS2), is set to go live on December 4, 2024. This phase will also impact forwarders who issue a House Bill of Lading. Going forward, maritime and inland waterways house-level filers are required to submit an ENS filing with HBL (House Bill of Lading) details to European Customs.
As declarants of an ENS filing, the following information must be submitted:
- The HS commodity code (6 digits) of the goods of a commercial nature
- The EORI of the consignee established in the EU, if such number was assigned to this party
- The information about Seller and Buyer (or owner of the goods in the case consignment does not involve commercial transaction) for goods with the final destination in the EU
Adequate descriptions of goods in plain and precise language are essential for the customs authorities to identify the goods. Please consult the ‘Unacceptable goods descriptions guidance’ available at Import Control System 2—Release 1 (europa.eu).
APL Logistics is already collecting this information from shippers and providing it to ocean carriers in charge of ENS filing. We are working with our technical teams to ensure we can submit an ENS filing directly or through the ocean carriers if necessary. As a result, we do not expect any impact on our customers’ businesses.
